Discretion having
been commended by
Lord, he was
with it, by Lord Camden
calling it the
law of tyrants. Discretion
would have
put before itself the
word sound; the hard
name would not
then have stuck
upon it.

Per J.B. discretion is
a word of parrot;
no determinate idea
employable in argument
comes out with
it.

What according to
Brougham requires
discretion is liquidation.

A Juryman is indeed
used to it: but as
eels are to be skinned:
people are used
to see him do the
thing, not he to do
it.

As to the subject matter
– namely damages,
sometimes it requires liquidation, sometimes
not.

So likewise costs.

But all this is nothing
to the purpose: to decree
and verdict discretion
are alike necessary.
