Observations on Bankruptcy Bill
Disinterestedness 2d
Introduction
1.
As to disinterestedness a
few more words.
A question already
discussed was to merits and
demerits of the Bill: but
another is — as to the
severity sincerity of the author's
advocacy of Law
Reform — i.e. a system
for putting an end
to denial of justice
etc.
2.
To ensure his contributing
to it necessary
are
1. adequate inclination
2. do ability.
3.
Neither has J.B. been
able to discover in
him, as above.
4.
Inclination would be
tolled by interestedness:
5.
Therefore disinterestedness
is so strenuously asserted
and inculcated.
6.
Believe him, never
would butter melt in
his mouth.
7.
From a fee as from a
hot coal his hand
would shrink.
8.
In this boast I see thrown
down a gauntlet — I here
take it up.
9.
Averment — By this change
I shall not gain money
or money's worth. Counter
averment — you would
gain considerably — thus
is issue joined.

Greater than this
appeared is Brougham's
real emolument —
Causes of increase,
these
or 2
1. Salaries not
unliquidated and
uncertain — but
liquidated and certain.
or 3
Sums large, which sell
for more than in
proportion compared
with small sums.
or 4.
Examples —
1. Church Livings
2. Army Commissions
or 5
1. Church livings —
Advowson of a living
with income less
per annum than
that of a Curacy
is unsaleable: with
high income for 14
years purchase,
undislocability sole
advantage over of
Living over Curacy.
or 6
Reason — £80 affords
bare necessaries: all
above, luxuries —
higher the amount,
smaller the number
of price-reducing
competitors.
or 7
2. Army Commissions.
Here, while Ensign's
£96.16.3 fetches no
more than £450,
Lieutenant Colonel's
no more than £310,
5s fetches £4500.
Disinterestedness 2o
or 8.
Judiciary and
military service being
assumed equally
desirable, the relative
superiority of the
patronage gained may
be mathematically
exhibited, thus
or 9
Price fetched for the
£95.5.0.£450 or
4 1/2 years purchase.
or 10
Whereas for the £310.
5.0 price fetched
£4500 or 13 1/3 years
purchase.
or 11.
Compare now the
salaries of the patronage
given up by Lord B.
with the salaries of
the patronage he
gives himself.
or 12.
Salary of the highest —
the Chief Judge, £2000.
or 13.
Assuming as above
10 years purchase as
the value of the
patronage we have for
the increased value
£20,000.
or 14.
Allowance must be
made in both cases
for the difference
between the perpetuity
and the 8 years'
possession.
or 15
True in the military
service is there increase
of power in addition to
increase of emolument —
but not less
true is it that the
military are exposed
to dangers and sufferings
to which the
Judiciary are not.

In the calculation
a friend of mine
offered me the assistance
of an appropriately
learned friend of his:
of their information
he result follows.
