1831 Nov.11 Bankrupt Bill
1. Eavils raised as to the motives in which this Bill originated: not imputations, he being above them.
2. Regnet the greater because the eavils were by Bentham.
3. Per Bentham the anxiety about this Bill looks as if it snatched at the patronage, which is but L 26,000 a year.
4. Whereas greatly diminished in "the patronage and other advantages. As to patronage, to L 35,000 a year is substituted L 10,000 a year "(lots L 17,000): item, lots of L 12,000 or L 14,000 a year in sineeured: total lots L 29,000 or L 31,000.
5. Of the patronage the reduction will be immediate.
6. If two masters are added, 70 small being the offices "cut off" 11 large will be those added.
7. For a man who "delights in patronage", these 70 small are more "convenient" than the 11 larger oned.
8. An incompetent person he cannot -dare not appoint Judge.
9. Not by favour are the present Judged made: not obliged by the choice made of them.
10. General result- Decisions improved in quality, delay lefsened: so expense, even were it only to suiton, namely in fees.
11. Hitherto, in the apportionment of feed, suitor's interest has been the last consulted.
12. By the Bill, the net amount of the fees saved is L 26,000 a year.
13. By this plan, very considerable is the patronage sacrificed: for patronage sacrificed, chief Justices of King's Bench + Lommon Pleas receives compensation: he of King's Bench L 4,000 a year.
14. By accepting chancellorship he would expeed to be a loser if he did not expect to remain in office.
15. Cut off by this plan is "every far thing of the Chancellor's emolument from Bankruptcy! L 7,000 or L 8,000 a year.
16. Objection- By thus reducing the emolument you think to keep place to yourself: for with so small a remuneration nobody else will take it.
17. Answer_ Without a fair compensation I could not afford to take a place thus burdened with a peerage.
18. Preferred by me would be addition to "retiring at pension" than "working salary".
19. My sole motive is the "wish to purify and amend the defects in the institutions of the country.
