Bankruptcy Bill Collectanea
Extract from the "Morn. Chron." 15 Nov 1831.
"Court of Chancery – 14 Nov.
"Smyth v. Smyth.
Before the rising of the Court,
his Lordship inquired if Mr. Carmichael Smyth
was in attendance, pursuant to his notice, to oppose
the resealing of a Commission of review."?
Mr Smyth having been called, and not appeared
appearing, His Lordship said inquired if the Proctor
for the other side was present, and having as certain
that he was, his Lordship asked if he had served Mr
Smyth with notice of the time appointed for hearing
his motion.
The Proctor answered in the affirmative, he and read the
notice of the motion, which was similar to one which
had been served on him on a former appointment
when he also failed to appear.
His Lordship said the notice was sufficient, and Mrs.
Smyth was clearly entitled to have the commission
resealed; as far as related to his own fees he would remit
them out of consideration for her distressed circumstances;
he could not answer for the fees of others, to whome a
separate application might be made.
Mr Edmonds having conferred with others of his Lordship's
officers, intimated to his Lordship that they would
not take theirs fees in the present case.
His Lordship, addressing the Proctor, said, then
yu will not have to pay any fees."
