Bankruptcy Court Bill Observation
From any thing that will be seen, let it not
be inferred, that it is my wish to see this Bill
rejected. Quite the contrary – what I wish is – to see
it new-modelled sublats jure nocendi: the venom
in it extracted out of it. The seventy Commissioners
seventy interpreters of the book of the Dæmon of Chicane,
constituted assembled and mixt together as
they are, constitute a most accomplished nuisance.
From this nuisance my earnest wish is to see the
England delivered: high indeed must be the price
that it would not be worthwhile to pay for this
deliverance, rather than not receive it.
Whatsoever be the arrangement in other respects
it ought not to be more other than a temporary one. Compared
with the whole field of the civil branch
of the law (meaning all that is no that does not
belong to the Penal) comparing it even with that
sub-branch of it which has for its subject
the relation between Debtor and Creditor, it is can not at
any rate but be anything but a partial one.
What I wish therefore in this respect, is – that by
this partial arrangement, supposing it even as far
as it goes, upon the whole a beneficial one – the ultimate
application of an all-comprehensive system
may not be prevented or obstructed
that the existing system be put into a state of repair with
as little expense
as possible: but that
a new one be not
on this occasion, and
on this part of the ground
created: a new one
which of any edifice tolerably well suited to the purpose be afterwards created on the site of it, will have to be pulled down, and the expense of it then
thrown away in waste.
