J.B. to France against Death(5)
Swindling they have separated into two sub-species.
To one they have given the name of obtainment of money
&c on false pretences: and to this they have attached
punishment in various ignominious forms – whipping
pillory and transportation all at option: and to which
punishments they found no difficulty in applying to
the institution and application of, the lower orders
alone standing exposed to the temptation of committing
it.
As to the higher orders, so far from having them
providing and applying to them punishment for the commission of it
exposing them to punishment for the commission of it
they have neither not only licensed it, but applied employed
the force of government to the purpose of enabling them
to substitute extortion to deception as a means of
obtaining the money on the occasion on which the false
pretence is made: the party in whose mine the deception is
fixt or produced or endeavoured to be produced,
being – not the individual from whom and at whose
expense the money is obtained, but the public at
large. Here then is a sort of species of component maleficence – composed
of extortion and fraud: and you see, my Fellow
Citizens how rich it is.
