Constitutional Code
Enactive nd Expositive
Art. 26. Art. 26 35. Note, that nullity invalidations
that of the incidents designated by the appellatives
nullity and invalidation, to no other purpose is mention is here made to no other purpose than that of exhibiting
in no other character than that of affording an example
of what is capable of being done, and to a great
extent is actually done, in and by the Codes of other
nations. In and by the present Code, no such effect
is, on any occasion produced, against in disfavour of no person,
on the occasion of any suit, is a definitive decree
pronounced, on any other ground than that
of the merits:(a) in a penal suit, in disfavour of no pursuer, on any
other ground than that of the non probation of
the offence charged: in disfavour of no defendant
on any ground other than that of adequate probation
made of the offence charged.(b)
