Publicity is the very soul of justice, in other words, without
publicity if what is done by a Judge as such, no adequate
security for the due fulfilment of the ends of the of the ends of ends of
justice so far as entrusted to him: his on the contrary so far from it, the
effect contributed to the disfulfilment of those same ends
how is it that by a mere change in the official appellation
given to a functionary of government, effects the direct contrivance
of each other are produced, and as such power producible
of those same opposite effects conferred on them.

Department suppose the Administrational in particular
the Defence force. Power conferred attached on Officer considered as belonging
to the magisterial grade, power and in view, leading in those
functionaries considered as belonging to the ministerial grade – leading
them on and committ to prison the functionaries belonging
to the force opposed to them, or in case of necessity
them to death on the spot, rather than suffer them to depart
unmolested – Such would be in the Administrative department, the
policy this of an arrangement analogous to that in the judicial.

Maxim. In the one department an arrangement is contributory
to the greater happiness in so far as it adds makes addition to the : in
the other, in so far as makes produces substraction from it – a maxim
to the effect – is it not anything less than other than a self-contradicting one?
is it not compounded of two, the relation of which to each other
is such that if either is true it is utterly impossible that while it
is so at the same time at which the other should be?

Yet, this is that a function to whom by the name attach
the name by which by the supreme authority of the State in the exercise
given to such its power in such the his official duty is designated
