1830 Nov. 10 4
J.B. to France against Death

40 Well but (says somebody) and what of that?
What objection does this afford to the existence of death
punishment. Possessing this as he at all times
has possessed whatsoever the power you speak of repre
speak of as being so mischievous, what mischief
has he eve in any of those shapes has he ever
done with it? I answer – to my recollection, none.
But this is not the now the question here is, whether
the attachment of Monarchs to this mode of punishment
being put out of doubt by experience, this attachment
has for its causes a persuasion on their part that the
maintenance of it is contributory to the greatest happiness
of the whole community, or the gratification which
in their own individual character they derive from
the possession of it. The use which power in the hands of
a King is of to him, consists in and is in proportion to
the extent of compliance he obtains by means of it
at the hands of his subjects: and to the existence of
such such compliance it is not necessary that to
any such suffering sufferance producing power any
exercise should ever be actually given: all that is necessary
is that in the mind of the individual subject to it
expectation of the eventual exercise of it should have
place. Whether in in their hands it is actually is productive of a balance on the side
of good is or on that of evil is another question: it
is the main question: it is the question with a view to which
this question concerning as to the cause of their attachment to
it is put.
For the reason just given
The more ample
the power the greater
will naturally be and
of course be a mans
attachment: and thence
for the purpose of the present
question as to
the cause, comes the
reason for bringing it
to view in all its
amplitude.
