Are they entered upon some separate book?
This is what I should rather expect to find
to be the case. But in this case the collection
of them would be performed with infinitely
less labour: unless besides their open books the
H of Lds have their secret books, the book in
question being of the number of those secret books.
This I should not expect to find.
Of every thing that concerns the formation
& composition of the Searching Commee I am
perfectly uninformed: what appears to me is
that either their attention had not been pointed
to the object here in question, or that somehow
or other they have been put by from the
accomplishment of it. Of the influence vested in
behalf of the chief profiter from the sham Writ
of Appeals presented to the intermediate Courts,
I had intimation from you: it looks as if on the
present occasion some such influences had not been inattentive.
The Appeals Books (I am assured) are open to every body:
ofit would be strange if the Writ of Books
(if distinct from the Appeal Books) should not be so too.
What is open to every body cannit have been shut
agt a Commee of the H of Commons? But if nothing
had happened to direct their attention to this
particular object, it is no wonder their researches
were not directed that way. But the omission
is it irremediable? At present, nothing can
be more flagrant than the misrepresentation,
howsoever produced— & that misrepresentation
injurious in the highest degree to the reputation
of Scottish judicature as compared with English.
Mr Rose is the person principally (though not
exclusively) interested in the concealment of the
sham Writs of Appeals to the H of Lds: as
Dr Ellenboss' is in do of do to the Intermediate Courts.
