But if with uniformity
& steadiness execution
& effect given to the law scanty
would be the fee harvest.

On the other hand, even if with uniformity and steadiness execution and effect were given
to the law main body of the law execution and effect were
uniformly and steadily given, scanty would be the fee-harvest
in comparison of which it is now that to that same mass of
law execution and effect is sometimes given, sometimes not. For
supposing any uniformity to have place, denied them
would be but comparatively speaking defences none or next to none. What is necessary
therefore to the abundance of the fee gathering harvest is that there

Misdecision to produce
defences
should be a well-asserted mixture of right decision and
misdecision; right decision, to breed produce demands; indecision to
produce defences. From this so satisfactorily accomplished
mixture comes uncertainty, that uncertainty of the law
which by those who prosper by it is so happily and
hastily toasted by with the epithet glorious: in contradistinction
of which it was that comes the encouraging declarations
once made by a Lord High Chancellor () that
no cause whatever slight was to be given up as desperate.

Nondecision by
delay productive of fees.

So much for misdecision. As to non-decision,
so far as it has non-commencement for its cause it is to the
fee-harvest no profit all loss. But the suit once commenced,
it coincides with delay: it is delay produced by
that particular cause: and all delay being while it lasts
devoid of justice to the plaintiff, operates as an encouragement
to dishonest defences. So true it is that for years
a regular partnership has been carried and continues to be
notoriously carried on between dishonest men with other mens money
in their pockets, and the Judge and Co. partnership form of Judge and Co.. By
Judge and Co. constantly offered a sale is this same commencement
called delay. As at the woollen drapers shop for such a a certain
such a sum of money you have such or such a length of broad-cloth
so at the Justice shop for such or such a sum of money you have
such or such a length of delay.
