Review of Reformers J. B. and Brougham
By the case of the Charles Jaques Commission is afforded in
exemplification in no small degree and interesting
of the need which practice here of being placed having the
benefit of a sound theory for its guidance.
Under the joint guidance of two conflicting principles both
recognized by called upon in established practice had the
authority on that occasion constituted to conduct its operations.
On the one hand was the principle by which is presented
on the part of the individual the prudent fulfilment of trusts, on the
part of government at large in great and the judiciary department in particular
the strict performance of a duty so universally recognized.
On the other hand was the principle of which the Statute
of limitations as they are called – and afford so many instances
of the application, the Statutes which prescribe a length of time
after the close of which rights demands which till then would have been
regarded as not incontestable, are to be regarded as
having evaporated.
Here then was a hint, a very hint. By
Jeremy Bentham with and his non-disappointment principle the hint was has been
untied. By Mr Peel with in his practice without principle – by
Mr Brough with his "principles and practice" it was his
and Mr Attorney General in pursuance of those same principles and practice
it has without thought or mercy been cut and hacked sometimes in
one place part sometimes in another as Chance dictated.
