1. First, as to the necessity.

What a task is this you have set me? Wanted you say a
Body of Laws, that shall be unlike all others: this you say is what
is wanted for Spain. ⊞ ⊞ Why? Because there are no others that are not miserably bad ones. Nothing can be more true. Such at least is my
opinion as well as yours. But what you are thus calling upon me
for is, the proof of it. Well: if a proof à priou will satisfy you, you
shall have it presently. A proof aposterious; is it that you want of
me? I hope not. As a preliminary, I should have to send you by
post all the laws that ever were made any where: in the next place
a commentary of my own upon every clause in each of them, acknowledging
that there is good in it, but stating what there is bad
and showing why it is bad. Will a sample satisfy you? if
it will, there is one already on the way to you. You may find it
in my Draft of a Judicial Establishment for France, March

Good, I am inclined
to think can in
comparison of the Spanish
then and now was the
existing French Judicial Establishment
as it was created from at
the time of the pening of
the a new Draft for that
purpose, by the Constitution
Committee of the
French National Assembly
in 1789. Good in comparison
of that same their existing
Judicial Establishment
was I am inclined
to think, that same
New Draught. In stead comparison of the one Establishment the system in France the one then proposed
by the Constitution Committee of the National Assembly.
The Judicial Establishment, even as it then existed, was (I should expect
to find) good in comparison of the one, then and now existing
in Spain, the one then proposed by that new Committee in good
I am inclined to think in comparison of the one then existing
in France. and now existing in England, was and is Good, in comparison of that same New draught with all its improvements

by that same Committee. tp be sure was, and is the Judicial Establishment then and now existing
in England. In the course of that work besides showing
what on that subject was, in my view of the matter, good,
I had occasion to show, as that the then existing Judicial Establishment was not only the then existing Law in France
and the Law proposed by the same Committee for France Judicial Establishment and Law belonging to it, but the Law of Law o England was as it still is abominably bad England although its should as above is in substance be found to be even
abominably bad: in a deplorable degree to its only justifiable and
professed ends; conducive to the concealed and ends opposite to those proper and professed ends.
