In Answer to Mora

adverse instead of conducive to right decision, by the inaptitude which
stands opposed to appropiate moral aptitude.

It is for this cause that Special Juryies were instituted. It is for this cause that they are preserved.

The general sinister interest not being deemed sufficient means
have been found of packing them. The functionary by whom they are
chosen is a man subject to the conjunct influence of the Monarch the
Aristocracy and the men of law.

In a certain class of courses are men acting under a pension revocable
at pleasure: that is hired to give such verdicts as in their opinion
will be acceptable to those who pay them.

This is done by annexing to the function of Special Juryman a
fee payable on each cause: and so contriving that the number of causes
in which the same man is employed shall be sufficient to produce that
effect.

As to the mode of appointment in political causes especially the object
being for the sake of appropriate probity to secure on each occasion a
body of Jurymen whose aggregate interest shall stand the best chance of
coinciding with the universal interest, they ought to be chosen out of the largest
number possible and by lot.

Challenging without reasons assigned Shall chalenges be allowed? to give any tolerable correct answer would
not be possible without too bulky a detail: It has an obvious use excluding
out of the Judicatory those on both sides those who are known or suspected
to be partial. But it has a latent mischivious effect, it is favourable
to the party who being in the wrong is conscious of being so: to the malafoide
suitor as we call him here. His care is — to clear the Jury of
as far as may be of the persons in whom appropriate aptitude in
both branches is most abundant. This mischief has been most noticed
since the Institution about 40 or 50 years ago of the Jury of 15 members
for trying of House of Commons election causes: it is called knocking out
the brains of the Committee.
