In Answer to Mora
States there is no such Libel Law All
All over the field of Penal Law it is good as far as it
operates, where the punishment is death: a punishment invented
to glut vengeance and render unjust condemnation irremediable
and exclude justice by destroying evidence, good, but
why? Only because there ought to be no such punishment as
destruction of life. I
In cases punished capitally where the defendant is believed
by them not to have committed the act, perjury being regarded
in the instance of every Juryman whose opinion
agrees not with that of the majority Jurymen in a capitally
punished case are placed between perjury and murder.
They begin to prefer the perjury and they do well: being so
continually compelled by Law to commit perjury to no purpose
it would be weakness to scruple to commit it to so good
a purpose.
In "Swear not at all" you may see how by torture Lawyers
force men whom they find honest to commit perjury.— but
you cannot see without coming here to see, with what solemnity,
with what unction pious Judges who have just been
producing the perjury conjure Jurors not to forget the regard
due to theis oaths.
No Jury in civil causes: Think not that of this reasoning
is the onlysupport ground: it e has a compleatly adequate support in
experience. In England it is by a single stated Judicatory the Law
Chancellors meet causes of the greatest importances not decided:

at all times: yet in the form of procedure is such as it
would might of the Moral object had been to render right
: yet at no time has it been so much or
started short on that judicatory the , so far by
defend upon the judicatory is less than in any of those other
judicatories which no other one Judge with a harder an occassional accompaniment of
Jurymen or four Judges.
