J.B. to Mora Letter 3
Now speak of a Jury – a Jury will not do for you. On your
existing system of procedure of a it can not be tacked by any
means, at least with any advantage. It would require a
system of procedure made on purpose to receive it. in In
Bonaparte's and some intendant systems, there was
that sort of basis for it: and so they have Juries though
ones. More on this subject in another letter.
Not As to publicity of judicature, you have example of it not only
in England, and the Ango-American States, but in France.
This or that Member – this or that Counsellor – might
possibly be disposed to consult me in relation to this or that
point: To give answers to any such question
would be a useless and endless business. Emperor
Alexander as he told me had ordered his Codifiers to put
such questions to me. I begged assured him any such order
would be of no use. Compleatness, conciseness and consistency it and clearness, these if they had any good qualities
would be the qualities of any codes: under those heads they
might arise as portions: whatsoever changes might be thought
fit to be made int he substance.
