1820. Sept. 30
To Mora

II. As to A As to the à posteriori argument, to render it
compleat, first set write down all the bodies of law that ever had
the force of law, by beginning or ending with the such as are in
the shape of which the characteristic is non-existence; then after
having laid down a standard, composed of a compleat body of
laws having for its object end in view the only default object above spoken
of, with the principle and less extensive subordinate reasons in which
in each one of its distinguishable clauses it has been grounded
compared with those several parts of it the correspondent
parts of your compleat collection of codes as above mentioned.
This done, take my word for it your demonstra proposition will
be found – will found to be at this end also – well demonstrated.

Thus much for the compleat work. As to any thing that I
have done in this way I can not refer you to any thing
better than a small sample. You may find it in my
Draught of a Judicial Establishment for France: in lieu of one that had been brought forward by the a Committee of the National Assembly and what
you see there you will not find much difficulty in applying
to Spain. The course of the argument will run thus. The
The Counsellor In comparison of the system there proposed the existing judicial Establishment of England is a
miserable chaos: In comparison of the existing the
judicial establishment proposed by the Committee is still worse than the judicial
establishment existing in England: the judicial system then existing
in France was worse than the exis judicial system proposed by
the Committee. Of this be not true, it is what to a degree sufficient for a practical conclusion I did then conceive
and do still conceive myself to have demonstrated in that work
and after reading that work you will I am inclined to think
find little difficulty in demonstrating that the judicial system
of Spain is still worse than the worst of these.
