So far as anything may depend on Ministers,
I sh fear I shall be in rather a bad case: at any rate, if my
letters which I hope you have received against the liberticide
laws have been published, or if what I have written in exposure
of their sinister interest in "Rid yourselves of Ultramaria"
comes to be published.
Tuesday Nov 14. Follows the result of a constellation
with my pillow. Circumstanced as Spain, I feel that if
on your side of the water the matter begins and ends as well it has begun with that paragr paragraph
in the Journal of the Cortes, I shall not the excitement will
not be strong enough to enable me to set about a Code:
and as to any other part of in the business that has from
the first been out of the question, as I observed above.
How can we deal with a Code so circumstanced? how can
we have any dependence on it? By the Constitutional Code
Article 106 the Codes day appointed for the meeting of the Cortes
is the 1st of March in every year: and its sittings are by the same Article the duration of its session is limited
to those men: extendible by Art. 107 to four months, but
never more than four months it can not legally sit in any
one year. Now on the 9th of this month Novr it will have
sitted out its extreme period of four months: does it will it
recommence its sitting as early as the first of March
next? If so then it will sit at if it sits thereafter the allowed
time of three months it will have sitted seven months
in this one year and in this way that Article of the
Constitution will have been violated. But by commencing its last
sittings on the 9th of July last instead of waiting for the
1st of March 1821 that same Article never violated: and
an English lawyer, if he saw his advantage in it could
tell you that thereby all the laws and measures acts and deeds of this
last Session are thereby void. If any provisions have been
made to reconcile these contradictions, no such provision do I see
in any Edition of the
Constitutional Code,
the date of which is
1820.
