J.B. to Mora
In speaking of the necessity of my working,
if at all, upon a compleatly independent footing,
nothing could be further from my wishes than that
of being the sole workman. It would not be fit I should,
even on the supposition of my being, in even so high a
degree, more competent than every other. For, age
or faculties might terminate at any time before any
considerable progress has been made in the work:
and, in that case, on the supposition that nothing was
done towards it by any body else, there would be some
much time lost. What I reckon upon, therefore, as an
indispensable measure is — that, whether I receive
the Commission or not, the Committee is going on
with its labours, just as if no such individual as myself
were in existence: in which case, even on the supposition
that, for the basis, my work came to be preferred
to that of the Committee, still with regard to a
multitude of local points in respect of which I should
be necessarily at a fault, provision will have been
made by the Committee in regard to what it might
be perhaps be agreeable to them afterwards to receive my
observations.
Another thing I should very glad to
see is — an invitation from authority for as many
individuals as should think proper to draw up,
each of them, a compleat Code. But, on this head,
I need not say any thing here:the matter being so
fully discussed in my letter to Emperor Alexander
in "Papers on Codification". Howsoever it might
have been in Russia under the wet blanket of despotism,
in Spain, at the present day, I should not
expect to find any want of Candidates. For, unless
his work were bad indeed, every such Candidate, tho'
his work were not accepted or made any use of, wd
by the very operation of making it, have qualified
himself, and at the same time shewn himself, in
a preeminent degree qualified for judicial and
other offices.
