Now understand all the while, that though independently
of all other considerations it would be an object with
me to give to Spain the benefit of my Brother's service, yet
in so f the much superior object is the getting the excitement
necessary to enable me to do justice to the subject
of Codification. You will therefore have the goodness to
keep in mind the making causing the one service to be
considered by those as a condition to the obtainment of
the other. Mr you are already in
communication with in relation to me. Count Torreno
and Mr you may upon occasion be in communication
with through M. . I have received
but yesterday from Dumont at Geneva a letter dated as long ago as 27th September, giving advice of the progress
made there on a penal code upon my principle. If
there be time – for this must be with M. Colomb by 3 0clock
I will send you a copy of it. My friends at Madrid may
therein see the importance of an eventual application to Dumont
to as proposed in a former letter of mine to you to
accelerate his edition of my works on the subject of
Evidence Procures, a subject which its very essence of
that of Procedure. Yesterday also through Minister from the United States, I received a communication
communication of a letter to him from
of New Orleans, stating a determination there to
make a Penal Code, and requesting information from
England. You will not be at a loss to see how great the chance
would be of me procuring custom from that State, and thence
by degrees from other States in the character trade of Code-making
if an honourable and commission should come
from your beloved in the name of your King. Also his
Dumont's letter inviting me two years ago in the name of his colleague to draw up for them a Penal Code. But this must wait till another post.
