seen again by brought before the Judge.] I see not
Nothing in this circumstance presents itself as being of itself any
thing like a conclusive proof of injustice on the part of the Judge
Suppose it ascertained that such or such a person would
be capable of deposing on this occasion in the character of a
material witness and that his place could not in an with adequate
adequate degree effect be supplied by any other. Supposing
that on this occasion of the prisoners in question
the examination had gone proceeded as far as the nature of the
case admitted, there would be no use in any ulterior
examination of the Defendant unless some special
occurrence presenting a demand for fresh inquiry had presented
itself.

Still however there remains an imputation and
that a serious one though facts are grounds are wanting
for the determination on what object or objects it should be fixt
the law system of procedure already in force at the time of the
enactment of the special restrictive or prohibitive law in question the provisions of this
same recent law itself, or the conduct of the Judge
The imputation circumstance in question is the
prisoners not being let out upon bail by what ground or
pretense could this partial remission of punishment the suffering
appointed, and in some cases necessarily appointed to be
applied produced antecedently to all the proof of transgression — on
what grounds or on what pretense was it or can it
have been refused? As to the transgression itself, nothing
for any thing that appears could have been more v
But it is only in an indirect way that the
place of the transgression in the scale choices of delinquency
has any claim to notice on the question whether
the defendant any restraint shall be
put upon the liberty of loco-motion on the part instance of the person
accused
