accused. Such provisional confinement is it necessary to
prevent the prisoner from eluding in the event of his conviction
the quantity of punishment adapted to his offence? Only
on the supposition of its being necessary to the
purpose can any such infliction be justified: an infliction
of which in case of non-commission
of the offence is punishment undue on the whole if it, since
in the case of commission, the place of apart as above undue in so far as regards
this part of it.
