1. The two instruments

One thing here seems altogether extraordinary strikes me with surprize. Not any
the slightest imputation does the law seem exposed to, even
according to the account given of it here given of it. Given of it? and by whom? even by the person very individual who
was the in the event was the greatest and almost the only
sufferer by it. In considering When occupied in the examination the alledged time of this law
as stated in the public pr (the state it was then in was
that of a proposed law but in which state however it was afterwards
spoken of as being passed into an actual law) not sparing had of
been the disapprobation concerns was the opinion which I felt myself obliged called upon to pronounce upon
it. But on that occasion that which the disapprobation had for its object was was the professed end in view that was
the subject
namely the prevention of all free assemblies for political
discussion: it was this end in view and the means on that
occasion announced namely the subjecting of all such assemblies
to licence: [ to licence from the hand to licence from the very persons
to whose power their influence would operate as a check
on pain of being altogether useless] rendering their existence
dependent on the a will which in proportion as they were
afforded a promise prospect of being of use could not fail to be
adverse: as if in a criminal cause, the sitting of the Judge
were made dependent on the pleasure of the Defendant.

On this occasion, to no such licence do I see so much
as an allusion made. All that is To render their
proceedings lawful all that I see stated as required prescribed by the
law is the giving the nature as above.
