Sir

I am at this moment subjecting your public
spirit, by you, I mean Cortes, Regency, every body, to one
of the severest tests, perhaps the very severest, that the public
spirit of any Government was ever subjected to. That
of the Spanish Government has already shrunk under it.
If it be in the power of any thing or any body to give them the
requisite strength for another and more successful trial, it will
be in yours.

In the Minute of the Cortes, if O do not overflatter
myself, and in consequence misconstrue one of its clauses, the assembly an opinion declared by the Assembly, was in substance
that the principles maintained, and the arrangements recommended,
in my works in general, and in particular those parts
which regard the field of legislation in the penal and civil departments
of that field were regarded by the Assembly as not
unworthy of its attention, on the contrary, as affording, in proportion
as they were more fully and particularly known, a
promise of being of ease:- "como incumbindo a sua apresentaçȃo
"no Congresso áquelle que tinha posto em practica as doubrinas
"liberaes do promiero e mais antigo Constitucional da Europa
."

In all those works on which such unexampled
marks not only of the sincerest approbation, but of that cordial
sympathy now for the first time perhaps ever felt or declared expressed in relation to a private individual, and he a foreigner, at a
distance, by a Sovereign Assembly, having the whole power of a
nation in their hands – in all those works, so far as regards the
details of legislation, such as would be expressed by a Code in
terminis, there can have been nothing beyond a the general description
of such a Code, not capable of furnishing any thing
beyond a general conception of it. What if, instead of a general
description of the thing, the thing itself were to be presented to you?
Would the present be an endurable one? I mean, a Code in
which every arrangement has for its support a set of appropriate
reasons.
