Penal Code

Ch. IIII Offences —
§§ Ch Homicide
12
S. Challenging
4
In some cases ratification
might of itself
suffice for repression.

In some cases, at least if not in any cases of homicide,
in many cases of challenge, this mode of repression
might be made of itself to suffice without calling in, any additional
infliction under the name of punishment. He indeed
who has nothing can pay nothing. But let the motive have
been what it will, so long as a man has any thing by which
he can be made to pay, such payment as far as it goes
will, besides the solace operate with most efficiency in
the character of punishment.
