This sinister project
the cause of the
original legislators'
blindness
By the sinister profit derived from this prolific
source of evil, it must have been that
the authors of this part of the Law are so completely
blinded to the inconsistency of denying
all pecuniary compensation to the case
where the mischief,i. e. the loss of subsistence
to the helpless relatives, is at it's maximum,
while it is not denied to any of the cases from
which the loss is at it's minimum. The gain
to the ruling one, not forgetting the instrumental
few, occupying the whole field of their
vision and solicitude, and producing in regard
to the suffering of subject citizens by dozens or by
scores, the effect of a total eclipse. Even too
favorable, perhaps, may on this occasion be the
supposition of simple blindness. In those numerous
cases, in which the fear of the obligation
of making pecuniary compensation is employed,
it is universally seen to operate as a repressive
But in this case, in proportion as it operated as
a repressive, the Lion and his jachaels would
be frustrated in their designs upon the prey:
of this most obvious of all repressives, the very well underrated
efficiency was therefore not improbably as
may the causes of it's being rejected. On the
law of forfeitures, a most obvious effect and unquestionable
object was the contributing to the
production of all crimes of which on pretence it was employed
as a repressive: and in the middle of the
18th Century, the first born saw himself for a
few moments afterwards Lord Chancellor, of the
most lauded of Chancellors, published in his youth,
under his name, and elaborate vindication of the law of
forfeitures.
