26 March 1826 Penal Code
Ch III. Offenses - Person & Rep.
§ 3. Challenging
§ Species
Self reputation defending
mendacious duelling
a bounty on mendacity
As common a cause of duelling as most
is a suspicion betrayed by the challengee
of a breach of the law of veracity, on the part
of the challenger. If in this field of action,
there be one case, in which absurdity is more
flagrant than in another, it is this. Veracity
is the virtue, a deficiency of which is imputed;
for disproof of imputation, what is the
evidence adduced - an evidence, by which
if virtue is proved in any shape, it
is in the shape of courage - the challengee
is shot. The lie, if uttered by the challenger;
is it by the course taken by the ball converted
into truth? Now mind the effect of the custom
in this case. It operates as a bounty
on lying. The ruffian utters lie after lie -
every lie remains uncontradicted, and
many pass for truth.
