5. In no other case does any ulterior evil take place
if when the wrongdoer murder directing is also known to direct from the
evil purpose – the purpose of produ committing the act of
consummation.

6. When and notwithstanding a the individual destined to
be the victim of the act of consummation refusing his consent
to it the intention is known to be compleatly given up, great
and variously diversified is the evil which the now for
primary act in question the act of preparation even though
all preparation is known to be at an and corresponding attempt
about to be made, effects from it.

Of this evil the quality and quantity depends upon
a great variety of circumstances on which are under
1. The intention of the murder with relation to the act of .
2. The mode or modes which operated as the inducements
3. The design he had in view – i.e. the nature of the benefit
which he himself from the leads thus given.
