§ Procuring: an information

Informant of a challenge
will be either challenger
or some person at large

When information to a Judge information is brought
from which it appears to him probable that by one person
it was intended and endeavoured to cause another person
to meet him for the purpose of fighting with mortal consequence
the purpose informant will be either the supposed Challenger or
some other person at large.

In either case information
accompanied or not with
a desire to be received
as pursuer

In either case his will be either
the information will be either accompanied or not accompanied
with an expression of a desire to be received as
pursuer, for the purpose of causing the appropriate remedy
such as the nature of the case requires, by the Judge

If challengee does not
appear as pursuer Judge
will either give direction
to pursue to Pursuer general
or accerse the challenge
to accept or decline the
pursuit

If the informer be not the not being the alledged or supposed challenger,
and declines appearing in the character of pursuer, the
Judge after recording his accusation will either give to the Pursuer
General character to pursue, or will cause accerse
the alleged or suffered Challenger to appear on a day and
hour in the mandate mentioned, to take upon him the function
of pursuer or declining it.

In the mandate challenger
informed that his presence
will be necessary as witness
or to propose need of
satisfaction

In the mandate he will be informed that this person
will be requested in the first place in the character of a deposing
witness for the purpose in the view of establishing the facts, in the next
place for the purpose of proposing the need of satisfaction, in
the third place for the purpose of its being ascertained whether
according to the assigned to the challenge, the pursuit
shall be carried on by the supposed challenger alone, by
the Person General alone, or by the supposed challenger and
the Person General in conjunction, as in the case of public-private
offences in general.
