in which it is at its minimum

No distinction made between the cases in which the
mischief is at the maximum and those in which it is at its
minimum: Instead before the aberration was made of the
three gradations of the mischief of an offence — between the mischief
of the first, second and third orders — those three gradations
corresponding to the as it was of the degrees in the genealogical
order of the offspring of an well fare influencing act of either any string
of either complexion black or white, no tolerably well grounded distinctions
