Constitutional Penal Code.
Slayer unmarried and childless forfeiture of the whole of his property
between the slayee's relatives and the public in proportion regulated
by his and their pecuniary circumstances.
If slayer has wife or child, half as above, to the use of such
wife, or child, or children in default of wife to their separate use
If he In default of property of his own, part of his earnings
for a certain time to be accounted for to a trustee of such representatives;
appropriate books to be kept, and the trustee to be on
the footing of a partner.
No matter whether the duel was fought within the territory
of the state on abroad. If abroad, all means in the power of
the Judge to be employed for compelling attendance on the
part of the Slayer; also, what means the nature of the case affords
for obtaining adequate testimony on the part of Evidence holders
resident abroad.
By the suppression of duelling, however, the wrongs
which at present it contributes to repress wd. receive encouragement.
This danger must be obviated.
