Now as to challenging, duelling, and the sort of repression applied
extensive excruciating and immeasurably extensive tyranny and accompanied followed by incidental
homicide, and widows and chil orphans bears; not to speak of
other cases modifications of duelling and challenging and duelling, of which there
are many differing widely in respect of the evil of the second and third order
but involving too much of detail for admittance here. And not
that in so far as the object of the tyranny is to repress action, the
evil of the third order has place; is it has reached the active faculty
and is there fixt itself.

If one life whose were In some cases Murder, in
other cases Manslaughter is the name given to the offence however death when homicide
is the result of it. Between the one and the other, no line determinate
and or intelligible. To Murder deathis undistinguishable
and inexorably unpardonedly attached with universal forfeiture: to Manslaughter
nothing beyond many more than a years imprisonment, and no actual forfeiture.
Of the product, if any, of the forfeiture the whole goes to the King
or somebody to whom for this purpose the name of the King is .
In no case to the widow or orphan anything.

To a man moving in a sphere in which duelling has place
imprisonment for a year is under such as which assurance can give to it the palliative capable of being reward
from affluence, a comparative trifle. Years of imprisonment in an
indeterminate number it might be worth a calculation while to
give for the advantage benefit derivable from the extirpation of the odious
possessor, present or future of an object coveted. Much
more abundant than it is would be the evil produced by the existing
system, if by the ignorance it suffers and nurtures it did not
to a considerable extent keep out of view the facilities and licences which it provides has provided
affords by those things which it has done as well as those which it has
left undone. Little does the manufacture malefactor in any of his shapes know or suspect
in what multitude abundance the learning of wise ancestors has framed
and treasured up instruments for his use.
