Ch. III Remedies
If in anything can arrest the hand of in a self-intended
murderer it will be the thought of the benefit that will be derived
from his punishment by those who are dearest to the man whom, in
proportion as he is determined in injuring him the injury
suffering injury he is about to inflict on him . To the King
or the Kings substitute, were it not for the loss to himself he calls forth no disquietude, could see
it go without solicitude.
The King or the Kings substitute has here been spoken of, such
being on the surface the letter of the law as bearing off the spool. But if the malefactor
be well advised this part of the punishment will not be anything
but in name. For thus are the substantive branch of the system
in a state of perpetual contradistinction: the evil which the atrocity
of the one aims at the clumsiness and improvidence and impotence
the other by its dimsightedness clumsiness
and impotence. By the substantive law the governance is
ordained: by Adjective law execution and effect are in appearance
given, in reality to an indefinite extent denied to it.
