1827. Decr. 25
Law Amendment or Penal Code Duelling extinguished

Retaliation

The Bully Duellist who is sure of his mark
and known to be so is possesses in relation to all who
do not share with him in this his faculty a power of
oppression more scarcely irresistible than is possessed by
the Monarch of an arbitrary Monarchy. In his hand
is the power of capital punishment: capital punishment
in the infliction of which the characters of party, Judge and
Executioners are united in his one person.

True it is, that in so far as fire-arms are the
weapons employed, the exercise of this tyranny is not altogether
without note, nor accordingly without check. But,
besides that the aim of a man who goes repairs to the combat
under the assurance of instant death not surviving it is not likely to be
very steady, where the sword is the weapon of which
the they bully is the master and under the received
laws of duelling he can contrary to have his the choice of
the weapon, the intended victim being altogether unpractised is decidedly less expert, the risk and consequently the check may
be next to nothing.

Amongst other powers included in this all-comprehensive
power of oppression, is that of Presence Banishment,
power of banishing whom he pleases, from any place or places from his own presence sharing any length or lengths of time
and that of any other person or persons he pleases:
in case of courtship for the purpose of sexual intercourse
banishing a favoured rival, then tearing asunder the bond
of love: under favorable circumstances between husband and wife, for the purpose
of adultery, producing the effect of a divorce.

Note that by

Note than Presence Banishment is applicable to in the character of
every species of remedy: suppositive, satisfactive, punitive
