§ 1. Introduction History
The time at which this practice took its rise
the state of society – of manners and opinions at that time
the mixture of ferocity and supersition which engendered
it – these circumstances, were even the evil effects of it out
of view should of themselves suffice might suffice to create give birth and warrant to a well-grounded
presumption of the absurdity as well as
mischievousness of it – at any rate in the
present state of society in the civilized world.
Though at present, the propensity to give and accept
the invitation is not altogether without reason, regarded as
a proof tool and measure of courage, courage alone can not
of itself have been the cause of it. For neither among the
Greeks nor among the Romans is any so much as an example
to be found of it: and neither among the Greeks nor among
the Romans did is any deficiency as compared with
modern times any inferiority supposed to have had place
in the article of courage. in respect of this supposed virtue. Duelling they turned over to Slaves
and convicts in the character and under the name of Gladiators.
Those circumstances, it should seem, may be stated
as having contributed by their joint influences to the production
of the practice: 1. the feudal system. 2. Superstition. 3. 3. the denial of justice
by reason of the laws defective and altogether unapt state of the
laws in respect of legislation and judicature. 4. the
aristocratical feelings arising out sentiment produced by the feudal
system on the part of that class of men of whose opinions
that of the Public Opinion Tribunal are principally composed.
