§ 1.

Things had gone on in this tract with undisturbed
smoothness – (how long can not now be found at present be ascertained), when a difficulty
presented itself. A case turned up, in which The parties, one or both were
rendered by age or sex disqualified from joining in this mode of clearing
up doubts of making appeal to and at the same time giving
judgment in the court of heaven. A mode of trial so commodious
was not to be given up, if by any expedient
it could be preserved. If the judgment of God could be delivered pronounced
by the conquering hand from of in one pair of combatants, why
not by that of any other? The question was the argument
conveyed by it – was unanswerable. To Fighting by proxy
succeeded thus to, or alternated with, arguing by proxy.

Where not only money but honour was to be
earned by wha that which but for the hire and the combat
would have been deemed and stiled murder, murders for
hire were not difficult to be found.

A no less apt criterion between right and wrong of the difference between right
and wrong might have been found in a combat between
a pair of bulldogs or a pair of gamecocks.

By a pair Gamecocks armed with spears might on this
occasion have delivered as well as grounded a judgment as
a judgment might have been delivered no less well grounded
than by a pair of blockheads armed with lances. But
the text which declares that without a fiat from the Almighty
an order a rule from the Judge whose Court is in heaven not a
sparrow can fall to the ground says not anything about Gamecocks:
and what is more texts were in no language but Latin
and Latin was Arabick to all men but a few Priests.
