1828. Jany. 16
Law Amendment or Duelling extinguishablePropositions
§. 2. Arguments for Duelling

But duelling has its defenders: and the defence made of it
has two grounds. One is that courage is a virtue: and that the act of duelling
is a proof, and the case obligation of a so exposure to the
obligation eventual necessity of engaging in it an efficient cause, of courage.
The other is that there are wrongs – and those capable of continual
occurrence and those to which every man stands continues
every moment exposed, to against which it is the only remedy.

To better their defence the answer is short. Applied Exercised
in a certain way in certain other ways it is evident a virtue
but applied exercised in this way it is a vice. In the ways cases in which
it is a virtue there are ways of exercising it, of and of cultivating
it without exercising it in this or any other way in which
it is a vice. It may be exercised in the to save preserve
life, without being exercised in a way to destroy life. Exercised
in a way to preserve life it is a virtue: exercised in a way to destroy
life at any rate that is to say in others not really substantively concealing it is a
vice: it may be exercised where it is a virtue without being exercised
where it is a vice.

The other defence has but too much justice in it. But
the law and appropriate remedy what is it? does it have? Not in the giving
encouragement to this ambiguous quality and propensity, but in the
giving applying to wrong in the shapes in question, that remedy which with
sure effect is capable of being applied by the hand of law.

The remedy provided by the practice of duelling as narow and partial
in its applicability, narrow to a degree in which altogether depletable
it extends not beyond the inch six: in the inch six it extends
not beyond the adult age, in the adult age it extends not to those
declining years which have most need. In respect of its
it resembles that which
under the existing system
is afforded held out by the hand
of law.
But the remedy and that a sure one, which
it is under
under the proposed system is held out by that same hand the hand of law, is an all embracing
one.
