1828. Decr. Jan. 3
Law AmendmentPropositions
Ch. II
Ch. III. Remedies for
§. 1. All together
I. Duelling & Introduction.

Challenging, Duelling. Homicide in consequence of
duelling – by these words are expressed the chain of concatenated
offences in which chain the last link – the essence in
its concatenated consummated state is a correspondent
particular and correspondent species of the genus homicide.

Of the several disorders of the body politic this presents
of above all others on which is the most complicated, among the most mischievous and the most difficult
to deal with, and reg raging among the most powerful and
influential classes in the most civilized nations, and hitherto bidding defiance to all the
efforts remedies which under the penal regimen have anywhere
been applied. For the extirpation of this disorder
the proposed system, supposing it adopted pledges itself:
and by the course method on this occasion pursued, will be afforded an exemplification
by which, while in itself eminently useful, will afford a more
ample elucidation than could be afforded by any other species
of essence, of the efficiency of the present pharmacopeia
which in these propositions is included brought to view.

1. First as to the nature and magnitude of the offences
2. then as to the method of combatting it the enquiry
commencing at the earliest stage, and exhibiting the particular
remedies together with the mode of applying them
through the several stages down to the last. 3. But the main root of
it will be seen lies in the imperfection of the law to wit of that part which
regards Offences affecting reputation: that is to say to the want of
all appropriate remedies to disorders of that class: these then
are among the remedies the provision of which will be requisite for
the completion of the cure.
