1. Passionate and r bloodthirsty Challenging Duellist –
2. Rancorous bloodthirsty Challenging Duellists: these will
Cause of the demand for distinction in the case of these sub-species,
difference in respect of the magnitude of the evil
of the 2d order – including the danger and the alarm, and the nature
and force of the remedies capable of being applied.
In the case of the passionate challenging Duellist in regard to the inchoate offence, that is to say the act of challenging the preventive
remedy is out of the question, there not being the between the design and the execution long interval of time
in which application can be made of it.
Only to the inchoate offence has this distinction any
application: for if notwithstanding the application made
of the suppressive remedy or remedies the design continues,
the species is by this perseverance changed being converted
into the rancorous.
If the rancorous species be taken for the principal object – for the object of
comparis reference and a comparison, the passionate will
constitute with reference to it a circumstance of extenuation
– an extenuative circumstance.
