§. 2. Remedies satisfactive compensative and punitive

Enactive

Art. In case of homicide in consequence
of the combat remedies satisfactive and punitive applicable
at option ( ) and discretion( ), separately or collectively conjunctively by the Judge are the following: necessary
are they to be in the first place brought to view as forming
the basis and ref object of reference to the several antecedental
remedies preventive and suppressive applicable to the offence
in its several successive inchoate states prior in time to this
its state of consummation.

1. Imprisonment, or say incarceration, for any term up to term of life, with or
without obligation to labour in a specially assigned form, or
at discretion, together with or without severities in any
other form or forms: as to which see the exemplified
by the several species of the Offences respectively denominated
Corporal vexation simple and vexation Simple.

2. Forfeiture Appropriation of any portion or the whole of the survivors
property. As above conducive provide for the case of the death of both.
So provide for the case of Mortification curable and incurable and the incurable vexation.
in the name of compensation, to the use of the
natural post obituary( ) and naturally dependent( ) representatives of the party slain: saving in case
of excess in the amount a transfer of the overplus to the use of the
public: saving also an allowance to the natural post obituary
representative and naturally dependent representatives, if any
such he has.

3. On disincarceration, presence-banishment, stationary or ambulatory,
from for years or for life, from the presence of the natural post obituary
and naturally dependent representative of the party slain.

As in other cases so in this, the term of the imprisonment will
be age-regarding: such or such a portion of the individuals probable
length of life, as per Life-Annuity Tables: power to the Judge
to modify the term by regard to consideration of idiosyncrasy regarding circumstances:
example the condition of the individual in respect of circumstances
affecting sensibility: of which see a catalogue in Introd.
