4. By every feature Of it the existing system is rendered
every other feature contributive to the rendering it altogether
inapt with reference to its professed and supposed purpose.

1. With very inconsiderable The only suffering the delinquent stands exposed to is
that by the bravery of which high reputation is obtainable
and obtained: attached to the punishment is a reward by
which it is always more or less likely to be outweighed.
As to death by the hand of law in the late Lord
" Principles of Penal law" (Eden afterwards Lord Auckland)
more than half a century ago it was asserted, and passed
without contradiction that a certain Major Oreby preached the only instance of an execution as for Murder
f in case of death from "a duel fairly fought": and in
such instance has it is believed has been presented since.

Remains death by the hands of the adversary. But
under English customs and maxims the peril is not in this
case so great as that which every man exposes himself
to after years of deliberation exposes himself to who
engages in either branch of the military profession.

In the United States in under the state of customs and maxims prevalent
in that country, this danger is in a prodigious degree more probable: the
habit of shooting at a
male being so much
more extensive yet still
is it not sufficient to
prevent the practice of
duelling, and that with a
mortal result beyond
comparison more frequent
than in Great Britain: the
official law being there deeply though not quite so deeply tainted with the same there as in the Mother country, and the law of Public Opinion⊞1

an accomplice with the
Manslayer,⊞2
⊞2 in their many of
them so mischievous forms
forms.

True it is, that in case of commission of the offence
under the name of Manslaughter imprisonment
for a term of extending extendable the length of a year is allotted provided by
Common the conception entertained of Common Law. But
by the habitual course of perjury which on the part of Juries
is so constantly, and zealously encouraged by Judges,
this occurrence is rendered unfrequent and not
by much too unfrequent to be such such sort expected as
to give determination to action.

As to the forfeiture its weight in the balance is equal to 0; the
evasion of it by legal
legerdemain being within
the power of every man.
