2 Preventive and Suppressive
To the Judge it will thus the Judge with the belong to consider
Having joint regard to the nature of the case and the
circumstances of the individual the Judge will then consider and
determine what means to employ for securing the forthcomingness of on the part of
the defendant: he will issue accordingly either an a simple accersitive
or say hither-calling, or a particular mandate addressed
to some Official Prehensive belonging to his Judicatory,
or an or in case of accersition, the appropriate arrangement for communication making for the judicial purposes of
being supposed made and established by the Letter post.
In The same determination he will make and
correspondent operation perform in the case of each such
accessary Co-delinquent as above.
So, in regard to each non-party individual to whose at whom
hand in regard relation to whom it appears adequately
probable that the nature of the individual case has put
it in his power – in the character of Evidence-holder to furnish
relevant evidence in any one or more of its three shapes – personal,
real, and written: in regard to personal evidence taking the requisite measures for the elicitation
of it in the oral mode or in the epistolary mode: preference
being given to the oral mode, except in so far as the advantage
to the direct end of justice attached to that mode, appears to be
outstripped by the advantage attached to the epistolary mode in
respect of the collateral ends of justice; to wit minimization of delay
expense and vexation: and in case of preference – give the
oral mode, whether to perform or cause perform the elicitative function
by himself or Depute at in his own judicatory or to transmitt transfer
the performance of orso to another Judicatory to wit that
within the covering of which the individual, the alledged Evidence
holder is believed to have at the time in question his address.
