§ Punishment as applied to the different cases

Distinction requisite to be made with a view to
punishment: to wit in quantity or in quality

The lithiferous design, exclusively so or the inexclusively or
say in the disjunctively: disjunctively in the sense in which the
word is has been in use among grammarians: exclusively, where nothing
but short of death can serve the purpose, can have the effect of conferring
the benefit, the desire of which constituted the motive in
which case death to the of every lesser suffering will of course
inexclusively or say disjunctively where by corporal vexation
either by that result or by corporal vexation in modes or
forms short of death the purpose might be conceived.

Modes are 1. Importing corporal vexation curable
2. importing corporal vexation incurable.

Modes of cor corporal vexation incurable are
1. Mortification incurable. 2. Disfigurement. 3. Disablement.
4. Mutilation

From the mode of combat which is the object of the proposed
indication is afforded respecting the purpose and the result
aimed at.

1. Challenge lithiferous or say aristocratical: 2. Challenge non-lithiferous. Lithiferous the challenge, in the case where the weapon employed
is such as is in its construction has for its object the production
of death: as for example arms the same as or recently
in this respect those employed in war: for example any
fire arms, pistols, among cutting arms, small swords.

Challenge Non-lithiferous the challenge in the case where
the weapon employed, as such as the choice of which in its form and nature considered
can not, generally speaking, have had for its object the production of death:
to wit, the hand checked: the best with or without the addition of a weapon made of wood – a state such as a staff a bludgeon.
