Law Amendment. Duelling extinguishable

Instructional to the Judge

On this occasion The evil to be avoided excluded is this. – The discourse
held on the by the intended Duellist on his examination is such as has for its
object and effect giving the public to understand that the
challengee understands a challenge that a desire to fight him
have continues to have place in the breast of the challenger,
in which case if the challenger fail to conform to it, should
non-compliance have place on the part of the challengee, timidity
will be regarded as being the cause of it, it will be
regarded as having timidity for its cause. All this notwithstanding,
such, at the time of the examination is the discourse and deportment of the
challenger, that the Judge does not regard himself as warranted
in taking such measures as he would be warranted take
in taking if the challenger had confessed it
to have been his desire to be regarded as having given
the challenge. In a word in a state of society in which
duelling is customary and in fashion, it will be an object of
endeavour on the part of a determined duellist so to shape
his decision and Deportment together on the occasion of his
examination so to shape his discourse and examination
together as to cause the public to believe that the challenge
h was given, while the Judge either believes it not to have
been given, or does not regard himself as warranted in
proceeding as if he regarded it as having been given.

Such This is the evil against which it will concern the
Judge to be upon his guard, and to take his measures,
and shape his discourse accordingly.
