Wrongful Homicide
§. 3. Its Species.

Distinction the first. Homicide is either 1. altericidal
or 2. suicidal. In the case of homicide the party
slain is either the slayer himself, or a person other than
the slayer. Where it is the slayer himself it is called suicidal or in one word suicide: where another, it is altericidal
or in one word altercide.
In future this Code where homicide
is the word employed
it will be understood unless otherwise expressed, to
mean altericide, to the
exclusion of suicide.

Distinction 2. Homicide when altericidal is either 1. Without
those concerns or 2.
Without consent or say non-consensual:
or in consequence of consent, say consensual: which in
which, is to wit where there are two parties and no
more than two is included homicide in the way of, or
say in consequence of duelling.

Distinction 3. Homicide, where non-consensual is either 1. justifiable
or 2. non-justifiable. In so far as regard deemed
necessary for the production of greater evil, it has been the slayer stands excl
exempted from punishment, and the act is termed justifiable.

In future In this Code where homicide is the word employed it
will be understood unless otherwise expressed to mean homicide altericidal, non consensual
and unjustifiable.

Division 4. Non-consensual homicide, when non-justifiable,
is either unalarming or alarming. It is unalarming
when the slayee being is in his nature unsusceptible
of alarm
where the condition of the slayee is such as to render
him unsusceptible of alarm, and at the same time such as not
to be productive of either alarm or regret on the part of any
other person.
