exclusively to wrongful homicide non-consensual are

of Offences against affecting person and property conjointly

1. Simple robbery
2. Highway robbery
3. Day-House-habitation robbery
4. Night habitation robbery

Reasons for the non-employment of distinction derived from
this source are the following –

4. If any difference were made, it would consist
in the attaching to the greatest quantity of the ordinary punishment an extraordinary
quantity on the account of this supposed aggravation of the evil of the
offence. But if from any such addition the only good effect that could
be looked for would be the causing the intended evil doer malefactor to
employ choose for the gratification of his maleficent appetite an offence
in a minor degree maleficent
in lieu of this
an offence of this species
and degree of maleficence.
But in this consideration
is involved the assumption
of the existence of another offence coming in this way in competition with this species of offence: and no such rival offence will it is believed be found.
