Art. 9. Subspecies of Robbery in its several species
those to wit 1. Simple Robbery. 2. Day habitation-robbery and
3. Night habitation-robbery –, these

1. Homicide committed with intention to produce temporary without intention beyond production of the
necessary incapacity of resistance, in self-defence against
attack made in conscience of the criminal demand.

2. Homicide committed with intent to kill produce death in revenge
for attack made in consequence of the criminal demand.

3. Homicide produced committed without intention beyond production
of temporary ca incapacity of resistance, but
without antecedent demand and time allowed for
compliance.

4. Homicide committed with intention to produce
death and without antecedent demand.

Note that in the case of homicide committed without antecedent
demand and with intention to produce death
has the special design may have had either of two purposes:
that is to say – 1. the more effectually and surely
and effectually to produce incapacity for resistance: 2. to
extinguish evidence: to wit the criminative evidence of the
slayee.

In the first instance the intent will be presumed to
have been correspondent to the result: but the presumption will
be liable to be rebutted by counter-circumstances.
