Law Amendment or Penal Code
Art. ( ) [Instrumental] So as the intention to produce
the effect is established, it matters not to the purpose
of criminality and punishment what were the means means employed.
If Where an unlawful act of corporal vexation tending to produce death
has been committed, the intention to produce the effect will
prima facie provisionally be presumed. But by , the intention
may be rebutted.
Where Satisfaction in Where the act was intentional
but the fatal event not, satisfaction in the shape of compensation
will be made to the post-obit representatives of the
slayee: but the punishment if any, over and above
the burthen of satisfaction will be only according to the
maleficent effect intended to be produced.
Ratiocinative
Reason Reason. 1. Only according to the maleficent effect
intended will be the consequent danger or alarm. 2. Compensation is
capable of being carried not only so far as to embrace
the whole of the delinquent's property in possession, but an indefinitely
large proportion of his property in expectancy, vested
and contingent, earnings by profit seeking labour not excepted.
[Means] The means may have been such as show
the fatal event to have been exclusively intentional with reference to corporal vexation in that very shape or indiscriminately
intentional with respect to corporal vexation in incurable
other shapes: that is to say morbification incurable, disfigurement
incurable, disablement incurable, and mutilation.
