Law Amendment or Penal Code
Motive, desire of pecuniary benefit. Species of homicide
such as to thus affect person and property conjunctly. More
maleficent is the offence in this case, than if the motive had
been ill-will to the slayee even though the fatal event had been exclusively intentional in a private account.
Reason – danger and alarm so much the greater.
Example. Motive, desire of pecuniary benefit. Place
intended a highway. Occasion, prosecution of a design of
simple robbery, highway robbery, day-habitation robbery
or night habitation robbery: which see: with the gradations
of maleficence in those several cases.
Occasion, robbery; in any one of its several above-mentioned
gradations, motive gradation in maleficence is pro- and
corresponding gradation in the magnitude of the evil of the seced succeeding
danger and alarm to the burthened by the circumstances following –
1. Cause of the act, assault by the slayee in consequence for preservation of his property immediately on receipt of the extortions mandate.
Design Act of the slayer not exclusively intentional, but indiscriminately
having for its object self defence preservation, with or without the production of temporary disablement
or say inability of resistance effectual resistance: from
a pistol for example.
2. The After Upon receipt of the mandate, the slayee
males no assault, but endeavours to make his escape
the slayer fires at him, to pro for the purpose of preventing
such escape. In this case indiscriminately intentional
with relation as to the fatal event, in conjunction with the
corporal vexation in other shapes is the character of the
act.
5. Without so much as issuing the extinction mandate,
the slayer fires the pistol or gives operation to any other
instrument of death.
6. Having produced as above reduced the slayee to a
state incurable of producing further resistance, the slayer either
through passion or for extinction of the slayee's criminating
evidence, perseveres and
purposely deprives him
of life.
