§. Existing System – its incongruities

In regard to homicide Composed almost exclusively Made up of incongruities will be seen to be the existing
system. Cause, inattention to the existence or
non-existence of the evil of the second order – the danger
and the alarm.

1. Incongruity the first: an all-embracing one. Distinction
none except between Murder and Manslaughter: Of neither species may the definition approaching to an intelligible
one. Yet in case of wher between the quantities
of punishment, the difference enormous for murder death:
for manslaughter imprisonment for a term not exceeding a year.

2 Incongruity the second. Distinction between consent
non consensual homicide and consensual disregarded not made. Yet
how wide the distinction is see under title Duelling
Denomination, Murder: Punishment mortal or not, accordant.

3. By distortion made between the case where the
fatal event effect was was made and intended. Began Denomination,
murder: Punishment, mortal to wit, accordant.

4. No difference between the cases where the
fatal effect was exclusively and indiscriminately, or say
incidentally, .

5. Acts productive of no evil in any shape
either of the second order or so much as the first, thence productive of pure good or if of the
first, none but what is outweighed made punishable. by the good. denominated Denominated murder.
Punishment, in so far as possible, accordant.

Judging Looking upon the evil Of his future contingent life the
evil, in his judgment, outweighing the good, a person puts a period to it.⊞
⊞ Sufferers, if any,
Wrongees, if any, his
post obituary representatives.
Punishment on him being impossible, it is inflicted on these already suffering persons, in his stead.
